Bill to Repeal WEP/GPO Reintroduced in Congress

Federal lawmakers seeking to repeal Social Security’s Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) are giving it another try this year.

U.S. Representatives Abigail Spanberger (D-VA) and Garrett Graves (R-LA) reintroduced the Social Security Fairness Act of 2023 (H.R. 82) in January. A similar bill received widespread bipartisan support in 2022 but never made it to a floor vote. Bills that don’t pass expire at the conclusion of each Congress.

The WEP and GPO, which are part of federal law, can reduce Social Security benefits for recipients of public pensions like Colorado PERA that serve as a substitute for Social Security. It’s important to note that a person’s PERA benefit is never reduced due to Social Security or other benefits.

While some bills in recent years have aimed to modify one or both the WEP and GPO, H.R. 82 seeks to fully repeal both provisions. As of early February, the bill had nearly 150 cosponsors, two of whom are from Colorado: Rep. Joe Neguse (D-CO-2) and Rep. Jason Crow (D-CO-6). The previous version of the bill received over 300 cosponsors, including four from Colorado.

Why hasn’t Congress taken any substantial action on WEP/GPO despite strong support? Essentially, it comes down to cost. Eliminating or changing the WEP/GPO provisions of Social Security would mean providing larger checks to benefit recipients, costing the system more money. Recent projections show the Social Security trust funds are expected to be depleted in about a decade, so it’s a tough sell.

Since major changes may be needed to shore up Social Security’s financial footing, it’s possible changes to WEP/GPO could be included in a larger reform package. But it’s not clear when or if that might happen.

What’s Colorado PERA doing about it? Since this is a federal issue to be determined by Congress, we encourage members and retirees to contact their members of Congress to share their opinion about these provisions and how they affect them. PERA will continue to work with the Colorado General Assembly to ensure PERA is on-track to meet its funding goal in order to continue to provide current and future retirees with monthly income in retirement that cannot be outlived.

      I agree that the PERA COLA is terrible. With inflation soaring, our pensions no longer cover what they have in the past. If CO legislature repays the money owed to PERA, will the COLA increase this year? When I first retired, the COLA was noticeable. Now it isn’t.

      GPO/WEP are extremely unfair to retired public servants. Fortunately, there is a group fighting very hard to repeal these punitive bills. Every single legislative session (every 2 years), we come closer to repealing GPO/WEP. In the most recent session, we actually got enough cosponsors that the repeal effort would have passed in Congress and gone onto the Senate. Except, for some reason, the bill didn’t make it to a floor vote. Once again, we are off to a good start, (the best one yet) for HR 82.         That attitude is part of the problem.
        I retired under the conditions set forth by PERA. I had no say in the contracted agreement to pay an annual 3.5% “guaranteed increase” ( their term, not mine) . Ergo… greed has nothing to do with it. It was a contract.
        It was income earned and deferred, owed to the employee by the State government. They were the ones who greedily took a defined benefit. Get on the right team…. No one is asking for anything more than exactly the conditions in place at retirement!

          True statement. We desperately need our promised COLA; however the Legislature of Colorado passed sweeping changes to our COLA formula in 2018 that was a break in their promise to us-disgusting and needs to be re-addressed now, especially with the huge inflation now of good and goods.

          I agree with Barry. We should not take it. The union representing firefighters was given $500 million from our Governor in 2020, along with lowering their retirement age to 50 and guaranteeing them a decent COLA. Meanwhile, retired teachers say we should stay quiet and accept what is happening to us. Why?

      Yup, thanks to PERA for reporting on the WEP issue. The author clearly, and I think accurately, writes about why Congress has not taken any substantial effort to get rid of the WEP. Disappointing though that PERA won’t weigh in on it just because it is federal legislation and because it is a “tough sell.”

      Since the author makes it clear PERA is not going to get involved with the WEP legislation because it’s federal legislation, that begs an answer to your question asking PERA to stump for a meaningful COLA for retirees. Let me add my own version (below) of your question to the author and see if PERA is willing to help.

      Will PERA help put forward a BILL to provide and fund an annual COLA determined by a commonly accepted formula used to assess the cost of living?

      Colorado PERA retirees are already penalized by low COLA’s, inflation, ever increasing medical costs and new retirees do not get a raise for a few years. Social security should not be reduced when earned. It is already reduced by not contributing once in PERA but should not be reduced on monies already paid to social security. Please keep this issue in focus. Contact congress!

      I get wacked because of GPO with a Government pension. Also get nothing from 1st husband SSI since I remarried at age 59. Sure wish SSI can change these GPO, WEP and remarriage law before 60 for many of us real soon.

          Agree with everyone’s comments!. I worked for 30 years as a Nurse Then I became a state employee as a nurse making less salary. All my previous work history was basically void. I receive peanuts, almost nothing compared to what I paid into Social Security. To add to the matter and what really is unfair is I will not recieve my husband”s ‘Social Security if he dies before me! We have been married 48 years this year My husband has paid into Social Security for 54 years full time! Totally unfair system. Social Security benefits should have nothing to do with our prior work history.
          We all need to write the members of Congress who are working on the bill for equality in Social Security. . Kevin your comment was excellent and thank you for the information and link you shared on the important matter.

      This was OUR money that WE paid into social security! We deserve it back!! We should not continue to be penalized for our employment BEFORE we were government employees! These u fair federal laws need to be fully repealed! The government needs to return our money and stop acting like it is their money!

      The problem is that our governments are already so overextended that they can’t pay both programs. I, too, paid into SS, but I believe it’s more likely that PERA benefits will be lowered for FUTURE retirees, than there will be any future additions. In addition, the state can’t print money like the feds can.

      PERA Board & Staff (PERA BS) really can’t help as they don’t work for rank-and-file PERA members. It’s a miracle they still let members (who pay for this microphone) post on this website. PERA BS work for the lawmakers, so contact your statehouse representatives and the governor. The lawmakers (a majority of them) are the ones who stole our annual increases and CoLAs, by pushing the burden of funding PERA on to the backs of workers and retirees, in order to keep more money in state budgets, for their pet projects, and instead of making actuarially required contributions (ARC) to the pension trust funds.

      BTW: I wouldn’t trust PERA BS to give you a straight answer that involves anything the legislature or governor controls. Remember the law was changed to put a bunch of legislative and gubernatorial hacks on the board, so that board members (the few PERA members elect) don’t have any power, even if they did want to represent the membership. Also, PERA BS are the ones that ran the dog and pony shows they called, “PERA Townhalls,” in order to provide additional cover for the crooks under the gold dome! When PERA BS goes through the motions of saying they oppose, support, or are neutral on a proposed piece of legislation, they’re simply stating the obvious or are already reflecting a political consensus (or the wishes of lobbyists which the lawmakers obey).

      This may be my opinion, but lawmakers aren’t just the ones who stole our pensions, they actually believe they saved PERA (ever hear the phrase, “we had to destroy the village to save it?”). Nevertheless, all we can do is continue asking them (lawmakers) to do the right thing.

      I suspect all the comments posted here will give you an idea of what to say and more importantly to NOT count on PERA BS for help. In terms of what to say to lawmakers… I recommend keeping it polite and very brief, and don’t go on like I have!

      Sorry for the length of this reply, but if it’s any comfort, many of us feel just like you. … but remaining silent is not going to get us what we are entitled.

    Well I don’t know if anyone ever reads these I paid into the social security system for approximately 50 over 20 years before they even passed wep when I was a young man paying for the American dream we didn’t have the money in those days but still had to pay the premium for social security I complained but was reassured that that you will be very happy when you get old well I worked for law enforcement full and part time for 50 years retired from that in April of 2022 but had side jobs through out the entire time and a person gets is well thank you for your service but you can’t have your social security and also served my country as well and that’s the thanks we get do senators congress men and representatives get penalized no and there wages and retirement s make ares look sick for crying out loud pass a reform or get rid of wep or gpo and let us be able live are last year s in some type of comfort we are only asking for what we paid for and yes we paid for it you are entitled to this but we will only pay you this but thank for your service but you can’t have your retirement thank you so much America

      WEP when considered is a ridiculous rip off as pointed out in your notes Congress is not subject any such ridiculousness.

      Spot on. I paid into SOCIAL SECURITY and later spent 32 years in law enforcement—so now I get a whopping $597.00 of the $ 1,142.00 I should have received. These criminals in congress are giving our tax dollars away to every cause they can dream up—as long as it supports their greedy causes, but seniors who have funded them all their life get ignored. They make me sick!!!

    I got whacked by Social Security. I would love to see that get fixed.
    I also got whacked again when we had our PERA COLA taken down, to actual or virtually, nothing.
    PERA works on our behalf, and they do the best they can for us.

      Can’t complain if you don’t contact her. I am a strong proponent of the Second Amendment and I see no relationship between it and COLA. More benefits for US citizens and senior citizens should have been included in the last series of bills signed by our political leaders!! Financial help for foreign entities seems to be a priority rather than taking care of the American citizen who pays for their spending sprees!

        Contacted Bennet, Hickenlooper and Ed Perlmutter, the latter of whom I had coached, and received a form letter from each of them thanking me for contacting them, telling me that they were actively concerned about my issue(s) and that they would consider my request. Never heard from them again. While on their web sight, I was not directed to any fundraising page. Odd that only one representative has that type of information available!!

      I made phone calls to all the Colorado national reps, except Boebert, encouraging them to repeal WEP and GPO. I also called Bennett and Hickenlooper. Regarding our dismal COLA, I contacted Barb McLaughlin, my district rep, on this issue. She has not responded. I am disappointed as she is a supporter of public education. I also contacted SecurePera and they responded immediately.

    I wonder if PERA has been proactive about the WEP/GPO issue. I read information from both California and Texas retirement agencies about how to advocate for the repeal of these measures, while PERA remains neutral. I am adversely affected by both these measures. My social security is diminished because of WEP and I cannot collect survivor benefits because of GPO. Why isn’t PERA taking a more active role in advocating for the repeal of these measures?

    In,ost my husband and he paid into SS since he was 16. Retired at 78 efore he passed. Because I worked govt I falli to GOP and cannot draw his Ss but I get a letter every year tell me what my SS widows pension is. This is wrong, Needs to be changed. I can as others use that as our debts still continue and they paid into it for us.

      I get a tiny amount my own Social Security (which causes me to also pay for my medicare) but I don’t get ONE PENNY of my deceased husband’s social security. I’m 74 and still working to pay mortgage, utilities, food, etc. I don’t work a social security job because I’d have to pay into it and NEVER see the money. I’m a substitute teacher…. yes, AT MY AGE!!!!!! I taught school for 30+ years and am penalized for it. I do receive PERA BUT ALSO started paying in to SS at age 16 which I will NEVER SEE!!! WHO GETS MY HUSBAND’S SOCIAL SECURITY?… NOT ME!!!!

    Most folks my age started working as a teen. We paid into social security and shouldn’t be penalized for working for the government as adults. We all have responsibilities and everything has gone up in price. Please consider our requests

      Agreed. I’ve paid into SS since I was 15, and plan to retire in about 10 years, which is just when SS funds are supposed to run out. Really feeling ripped off.

    I read all of the previous comments, and I think that you all should write your congressman and voice these same concerns, encourage them to vote in favor of HR 82. It sure can’t hurt. I just did. I am in the same boat. I worked for the State of Colorado for 25 years, but had jobs in the private sector prior to and after those 25 years, and am still paying into Social Security.     Seems like PERA is deaf to our voices and doesn’t consider our needs.

      The GPO and WEP basically reduce or eliminate (a) social security retirement payments if you collect a PERA pension, and (b) the social security survivor’s benefit if a person receives a PERA survivor’s benefit.

      In my case, I paid into social security for over 22 years, plus part-time employment while working for a PERA employer. I get roughly half of the social security benefit I’d be receiving if I’d just quit working after that 22 years.

    Something else to consider and that is closer to home, is getting legislation passed in Colorado that would exempt all (not just Social Security) pensions, from Colorado State income taxes. This is now the law for Social Security recipients in our State and with no cap, as I understand. While there is currently a capped age determined exemption of PERA pensions, the SS exemption should also apply to PERA pensions. Equal and fair treatment. Anyone know who supported and got the SS exemption bill to the Legislature? They may also be supportive for PERA retirees exemption.

    Contact Your U.S. Senators & Representative To “Support H.R. 82 and Repeal The Windfall Elimination Provision (WEP), That Hurts Retired Government Workers!”

    Contact The Governor and Your Statehouse Representatives To Ask, “They Provide A Meaningful Cost Of Living Adjustment (CoLA), Or Annual Increase, For PERA Retirees, Because The Current 1% Annual Increase Is NOT Enough To Keep Up With Inflation.”

    You don’t need to go into any detail in your first communique, politicians just want to know the issue as briefly as possible so they can count the number of constituents that contact them about it, before they decide it reaches a level for further action… In the meanwhile members of their staff put you on a(n) (e)mailing list soliciting campaign donations and some vague statement about sharing your concerns… That’s ok – that’s how the game is played – It’s just the first step!

    Note to PERA: We hear your explanation in this article that you will not get involved with the WEP legislation because it is federal legislation. That’s disappointing but it raises the following question.

    I also had a husband that paid into SSI for 30+ years before he passed. I had to go work at age 56 after raising my developmentally disabled son. I wasn’t able to work for many years and didn’t pay very much for my SSI. Nevertheless, I’m now 70 years old, working full time as a teacher in Pueblo,and I cannot survive on my PERA pension. The money I get from my husband’s SSI is his money that he paid all of his working life and I have all rights to it. He’s not going to collect it, obviously, so why shouldn’t I get it without penalty. My PERA retirement is also mine. I work hard to get it and I deserve it without penalty. I cannot live a comfortable, middle class life on either one, but I would be okay with both. The argument of SSI becoming insolvent in a few years is a matter of government priorities. The bottom line is, this money from both places, has been paid into with good faith from my family and me. It’s mine and should be looked at as so! I have emailed my state representative and senators. Hopefully, they will set these injustices straight for all public servants that are being punished by these policies.

    I am grateful you are trying to fix this issue! I worked many years in the private sector and contributed much to Social Security. I changed careers late in life to become a teacher. Teaching is a labor of love and a contribution to society. It certainly is not about the pay.

    Now that I am contributing to Pera, Social Security only wants to give me half of my contributions…which were my money to begin with!!! I would have a more sustainable income in retirement if I never became a public servant. Our society should not discourage and create punitive measures for public workers, but rather create incentives for them.

    Please support a modification to WEP …
    WEP is not applicable if one has paid into Soc Security for 30 years.
    Please support the reduction of 30 years to 25 years.
    This modification is likely much easier to pass than repeal

    We can send billions of dollars overseas to foreign goverments but cannot seem to find the money for federal employees pensions ( money we earned) Its time WEP is passed and our full pensions restored. NO MORE EXCUSES CONGRESS ACT NOW!!!

    Before & during a carreer in the professional fire service I worked under Social Security. My benefit should have been around $700/month at the time I filed. My benefit was reduced 60% to $236/month because of the Windfall. Once my wife retired and we went to Medicare B, that reduced my benefit another $174, plus pay federal income tax on 80% of that leaving me with about $75. I inquired about receiving half of my wife’s SS, but because of my fire pension, I would receive no SS beneffit at all. My wife, in a similar situation worked 29 years under SS and then had 20 years as a teacher. Her SS also affected by the Windfall, was reduced by 20%. We urge all lawmakers to repeal this unjust provision and give us what we earned and deserve.

      We may have a pension for now but with only a 1% COLA we are living on less than we were when we retired in 2007. We have lost over $600,000 because we are not getting the 3% COLA we were promised. Plus we are screwed on SS. Had I known this I would not have worked under PERA. It has turned out to be a bad thing. Only government employees are getting screwed on the SS. RR employees and others still get their full amount. If SS is so poor how did Pelosi take millions of $$$ from it to impeach Trump. It’s time for the government to replace all the money they’ve stolen from SS.

    Finally at the age where I can draw Social Security. Retired through NM PERA which is the same gig as in Colorado. Now I find the SS benefits I receive from 20 years of work making a “substantial wage” prior to my government job will be reduced 43.5%, thanks to WEP.
    That just doesn’t make sense to me.

      Ronald Reagan and the Democratically controlled Congress with Biden balanced Social Security on the backs of state and local government workers in 1983 (an illegal ex post facto law for folks who had already started working and paid FICA contributions!).

      Only the new Congressman in the Southern part of New Mexico, Gabriel Vasquez, has failed to sign onto H.R. 82 … write/email him along with Sens. Henrich and Lujan, because the bill might get to the Senate?

      Sure, you get stuck on their mailing lists asking for donations and saying how great they are, but that’s how the game is played.

      I agree the WEP makes no sense!

    I am wondering if the congressmen/women and senators are under the wep program.
    I also was not told at the time I signed up for my social security that if I signed for my husbands I would not be penalized after his death. This entire program is unlawful in many ways and I feel that congress and senate should not vote themselves a raise as long as the wep program is in force. Their SS is extremely large due to the extremely large salaries they receive for taking away the money taken from our paychecks! You.people are in those positions paid for with our dollars. You sure don’t act like it
